Coalition of Attorneys General and Nonprofits Comes to Florida Parents’ Aid on Appeal

This May we filed an appeal in the 11th Circuit Court of Appeals on behalf of Jeff and January Littlejohn in our federal lawsuit against the Leon County School District (Littlejohn v. Leon County School District). This case, like far too many around the country, involves a 12-year-old girl who was transitioned without her parents’ knowledge and even after school officials had written notice that the parents did not approve of their daughter transitioning at school.

As happens in too many of these cases, the federal district court granted the school district’s motion to dismiss. Child & Parental Rights Campaign immediately appealed the dismissal to the 11th Circuit Court of Appeals to vindicate our clients’ constitutional parental rights.

We filed our appellate brief explaining why the trial court’s decision to fail to uphold one hundred years of precedent establishing parental rights as a fundamental right protected by the U.S. Constitution needs to be overturned. A week later, a coalition of 67 organizations and individuals and 21 State Attorneys General filed amicus briefs, or friend of the court briefs, in support of our case and standing up for the right of parents to determine the education, upbringing, and mental health care of their children without interference from government school officials.

We feel confident that the law is on the side of the parents in this case and that the 11th Circuit Court will rule in our favor and send this case back to the trial court where the real work begins.

At the same time, we are looking at a critical new multi-state lawsuit in which a 14-year-old girl was secretly transitioned at school against her parents’ will, leading to her being sexually assaulted at school, running away, placed in state custody, and thereafter raped and sex trafficked to Texas because of interference from government officials. Thankfully, Texas officials returned her to her family. All of this started because government officials decided they knew better than a child’s parents how to treat her mental health issues.

We are developing a war chest to take this case on and to make sure we can handle all of the lawsuits we are currently involved in, while continuing to pursue other cases where parental rights are being trampled.
